Terms & Conditions

TERMS & CONDITIONS
 

1. Overview

These Terms & Conditions apply to your use of the North Star Marine Brokerage Pty Ltd (“North Star”, “we”, “our”, “us”) website and services.

By listing a vessel, submitting information, or engaging our services, you agree to these Terms and our Privacy Policy.

North Star operates across Australia and provides marketing and facilitation services for the sale of vessels.
 

2. Our Role

North Star provides:

  • vessel marketing and advertising

  • listing services

  • facilitation of auctions via third-party platforms

North Star does not:

  • act as auctioneer

  • act as agent in the sale transaction

  • handle funds, escrow, or settlement

  • verify ownership, title, or condition

All sales occur directly between the Buyer and Owner.
 

3. Auction Platform

Listings may be placed on a third-party auction platform:

Boat Auctions Pty Ltd (ACN 673 876 152)

By listing with North Star, you acknowledge:

  • North Star is not the auctioneer

  • North Star is not a party to the auction contract

  • the auction platform’s Terms & Conditions govern the auction process

If there is any inconsistency, the auction platform’s terms apply to the auction itself.
 

4. Fees

Listing Fee

A $500 upfront fee is payable when submitting your listing.
This fee is non-refundable once your listing is submitted.

Success Fee

If your vessel sells for $5,001 or more, the following applies:

 

$500 + 2% of the final sale price

When the Success Fee Applies

The success fee is payable if the vessel is sold:

  • via auction

  • via a “Buy Now” option

  • via private agreement with a buyer introduced through North Star
     

5. Introduced Buyers

An Introduced Buyer includes any person who:

  • bids or registers on the auction platform

  • enquires about your vessel

  • engages with your listing

  • becomes aware of your vessel through North Star marketing
     

6. Anti-Circumvention

You agree not to bypass North Star to avoid fees.

If your vessel is sold to an Introduced Buyer within 90 days of introduction:

the success fee remains payable.
 

7. Owner Responsibilities

By listing a vessel, you confirm that:

  • you are the legal owner or authorised to sell

  • the vessel has no undisclosed encumbrances

  • all information provided is accurate and not misleading

You must:

  • keep your listing information up to date

  • notify us if the vessel is sold elsewhere
     

8. Sale Commitment

If:

  • your reserve price is met, or

  • a “Buy Now” offer is accepted

you agree to proceed with the sale.
 

9. Buyer & Seller Responsibility

The Buyer and Owner are solely responsible for:

  • inspections and due diligence

  • negotiating terms

  • payment and settlement

  • transfer of ownership

North Star is not responsible for:

  • buyer default

  • disputes between parties

  • condition or accuracy of the vessel
     

10. Auction Disclaimer

North Star is not responsible for:

  • auction platform outages or technical issues

  • bidding errors or interruptions

  • auction delays, cancellations, or rescheduling
     

11. Listings

We reserve the right to:

  • edit, reject, or remove listings

  • require corrections to inaccurate information

  • decline listings with unrealistic pricing
     

12. Refunds

All fees are non-refundable once your listing is submitted.

This does not affect your rights under the Australian Consumer Law.
 

13. Limitation of Liability

To the maximum extent permitted by law:

  • our liability is limited to the fees paid

  • we are not liable for:

    • indirect or consequential loss

    • failed sales outcomes

    • loss of opportunity

14. Indemnity

You agree to indemnify North Star against any claims arising from:

  • inaccurate or misleading listings

  • ownership disputes

  • breaches of these Terms
     

15. Unpaid Fees

If fees remain unpaid, we may recover:

  • the amount owing

  • legal costs

  • interest on overdue amounts
     

16. Privacy

We collect and use personal information to:

  • manage listings

  • facilitate auctions

  • communicate with buyers and sellers

Your information may be shared with third-party providers, including auction platforms and payment processors.
 

17. Governing Law

These Terms are governed by the laws of Australia.
Disputes may be brought in the courts of the relevant State or Territory.
 

18. Updates

We may update these Terms from time to time. Continued use of our services constitutes acceptance of any changes.
