1. Definitions

• Company / We / Us means North Star Marine Brokerage Pty Ltd, T/A North Star Marine

• Website means our website and services

• Seller means a person listing a vessel

• Buyer means a person enquiring, bidding or purchasing

• Vessel means any boat or marine asset

• Auction Platform means a third-party platform
   

2. Nature of Services

We provide:

• Brokerage services (acting as agent for sellers); and/or

• Platform services facilitating listings and introductions

We do not:

• Own vessels listed

• Guarantee sale outcomes

• Warrant listing accuracy

• Act as auctioneer unless expressly stated

Unless otherwise agreed in writing, any sale contract is strictly between Buyer and Seller.
 

3. Third-Party Auction Platforms

We may utilise third-party auction platforms to facilitate vessel sales.

Where a vessel is listed via an Auction Platform:

• The auction is conducted solely by the platform operator

• The platform acts as auctioneer and agent for the Seller

• The sale contract is between Buyer and Seller only

• The platform’s terms and conditions apply

North Star Marine Brokerage:

• Does not control bidding, auction conduct or outcomes

• Is not responsible for auction cancellations, errors or failures

• Does not guarantee any sale result

All users agree to review and comply with the relevant Auction Platform terms.
 

4. Seller Obligations

The Seller warrants that:

• They own or are authorised to sell the Vessel

• Information provided is accurate and not misleading

• The Vessel is free of undisclosed encumbrances

• They comply with all applicable laws

We may request evidence of ownership or remove listings at our discretion.
 

5. Buyer Responsibilities

Buyers must:

• Conduct their own inspections and due diligence

• Verify condition, ownership and suitability

• Obtain independent advice where required

All vessels are purchased on an “as is, where is” basis unless otherwise agreed.
 

6. Transactions and Payments

Unless otherwise stated:

• We do not hold client funds

• Payments are made directly between Buyer and Seller or via a third party

• We are not responsible for payment disputes or defaults
   

7. Fees

• Fees are disclosed upfront

• Fees are generally non-refundable

• Pricing may change without notice
   

8. Identity Verification and Fraud

We may:

• Verify identity

• Refuse or suspend access

• Report suspicious activity

We are not liable for fraudulent conduct between users.
 

9. No Advisory Reliance

Any guidance provided (including pricing, auction strategy or sale method) is general in nature and does not constitute legal, financial or investment advice.

Users rely on such information at their own risk.
 

10. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for:

• Loss arising from transactions

• Misrepresentation by Sellers

• Buyer default

• Vessel defects

• Auction platform conduct

Liability is limited to fees paid for our services.

Nothing excludes rights under the Australian Consumer Law.
 

11. Indemnity

Users indemnify us against any claims, losses or damages arising from:

• Breach of these Terms

• Misrepresentation

• Participation in transactions or auctions
   

12. Website Use

Users must not:

• Provide false or misleading information

• Interfere with platform functionality

• Misuse content

We may terminate access at any time.
 

13. Intellectual Property

All content is owned by or licensed to us.
Unauthorised use is prohibited.
 

14. Privacy

Use of our services is subject to our Privacy Policy.
 

15. Termination

We may suspend or terminate access:

• For breach

• For risk management

• At our discretion
   

16. Governing Law

These Terms are governed by the laws of Western Australia.
